Injured Worker

I had a specific event at work - witnesses, no questions. My employer supported my claim and wanted me paid. I ruptured a disc in my back and required surgery. My employers workers compensation carrier, Frankenmuth Insurance Company was ok in the beginning until they heard I needed surgery. They clearly were put off by the potential of a "more expensive" claim. I had to deal repeatedly with the rudest lady ever. Jill W - she was horrid. I finally asked her why she was always in a bad mood. She said she was over worked, had too many claims, her boss knew nothing about WC and a co-worker kept trying to boss her around or something to that affect. I did now want to counsel her - I just wanted her to be decent and pay my wages on time. My employer had to call to remind her when my checks were due. I finally asked for the manager and I got some guy who was a total idiot and just pushed me back on her. Now she was worse because I went "over her brainless head"
I got a lawyer because I couldn't get my surgery approved. Jill said she didn't have all the medical, she (who has no medical background) thought maybe I had degenerative issues so she sent me to an insurance company doctor. He agreed with my doctor and said I should have surgery and that it was related. By now, dipstick Jill was not going to back down albeit she had no basis for continuing to dispute my claim.
It took months but right before trial - I got my surgery approved and my back wages paid. My employer moved to a new carrier because Frankenmuth Insurance was so bad. They claim to sell "claims service" but if this is what they are selling - look out!

Dear Tom:

Unfortunately, your story is not an exception to the rule. You've been caught in the gears of an entirely broken machine...the worker's compensation system. It's not just Michigan, it's nationwide. I'm glad you finally got an attorney.

For anyone reading this, please understand that being longsuffering and nice gets you nowhere. If you have a Workers Comp injury, consult a personal injury attorney IMMEDIATELY. The attorney can advise you about your legal rights in your state. You may not need to retain that attorney, but you're crazy if you do not get an early consultation.

If you act like an asshole, you will negatively affect your case. You need a designated asshole, and that is your attorney.

Repeating...if you're injured on the job, get an attorney. Period.
