Mr. Bolin

I reached a settlement with cotton states mutual insurance concerning a wreck, which my car was totaled. It took over 12 months to settle. During that time I put the car in storage. I sent them a signed title for my car. They sent a check, but put a "Stop Payment" on the check. They stated they stopped payment because, the car was put in storage without their knowledge. I now have no car, no title and no money! Now the title is in cotton states name and is now a salvaged title!

Any help would be appreciated.

Russ Longcore's response:

Mr. Bolin-

I need to know more to help you. Why did CS stop payment on the check? It makes no sense that they complained about the car being in storage unless you expected them to pay the storage fee, which they are not going to pay.

Have your attorney send them a Certified Letter requesting the settlement check immediately. At the same time, call the Alabama Department of Insurance and file a complaint. Cotton States HAS to respond to the complaint within a certain time period. Doesn't Cotton States still owe for the car?

Did they send you back a salvage title? Still makes no sense. As I said, I need more info.
